Elk Creek Fire Protection District’s Fire Marshall can assist you with obtaining all the proper burn permits and answer any questions by calling 303.816.9385, Monday - Friday, during normal business hours. International Fire Code section 307:

With regards to controlled burns, Elk Creek Fire Protection District operates under the guidelines of Section 307 of the International Fire Code. Pertinent parts of that code are paraphrased here:

307.1 General. A person shall not kindle or maintain or authorize to be kindled or maintained any open burning unless conducted and approved in accordance with this section.

307.2 Permit Required. A permit shall be obtained from the fire code official (Elk Creek’s Fire Marshall) prior to kindling a fire. The permit shall only be issued to the owner of the land upon which the fire is to be kindled.

307.2.2 Prohibited open burning. Open burning that will be offensive or objectionable because of heavy smoke or odor make such fires hazardous and shall be prohibited. The fire department is authorized to order the extinguishment by permit holders of hazardous fires.

Burn Permit Requirements:

1.Garbage can not be burned at any time.

2.Religious and other ceremonial fires must be permitted by the ECFPD.

3.County burn permits cost about $50.00, there is no ECFPD charge, however one is still required.

4.All burn permits expire on December 31st of each year.

5.Campfires must be cooking fires (see cooking fires).

6.Cooking fires are allowed on private property under all of the following conditions:

a.There are no burn restrictions in effect.

b.Fire is no more than 3 feet in diameter.

c.Flame height is no more than 2 feet high.

d.Fire is located at least 25 feet from any combustibles, including structures.

e.A sober adult constantly attends fire until it is completely extinguished.

f.A hose and nozzle is available for instant water supply.

g.Property owner is present, sorry renters.

h.The ECFPD is notified prior to the burn by calling 303.816.9385.

7.Slash can only be burned with a permit. In order to obtain a permit please contact the Jefferson County, Monday through Friday during normal business hours. A few of the many requirements are:


b.Slash burn permits are typically set for use between November 1st through March 31st.

c.There is a minimum of 2 inches of snow cover on the ground.

d.The ECFPD is notified prior to starting the fire by calling 303.816.9385 after 8:00 am on the day of the burn.

e.The fire cannot be started before 10:00 AM.

f.The fire must be completely extinguished by 4:00 PM.
